A work permit for foreign employees in Mauritius is not only the employee's paperwork. The company that wants to hire a non-citizen is the party that must justify the post, describe the pay and answer for the worker's conditions. If you plan to hire a foreigner through a Mauritius company, treat the permit as a compliance project with its own file, owner and calendar.
This page covers the employer's perspective for ordinary employment. It does not cover investor or professional residence routes, which follow different logic and different tests.
What the permit is and who applies
Under the Immigration Act 2022, a non-citizen who works in Mauritius needs an Occupation Permit or an equivalent work authorisation. The employer normally sponsors the application, because the permit is tied to a specific job and a specific contract.
In practice the company must be in good standing before it asks to hire anyone from abroad. A company that has missed filings, has no properly constituted board or cannot show who runs it will struggle to look credible. The corporate compliance overview lists the baseline obligations that sit behind any sponsorship.
What the employer must be ready to prove
Authorities look for evidence that the hire is genuine and that the worker will be treated lawfully. Requirements vary by permit category and change with finance legislation, so confirm the current list with a qualified adviser before filing. The themes below recur.
A real post and a real company
You should be able to show that the business exists and trades, that the role is needed and that the contract matches the job described. A shell with no activity is a weak sponsor. If the company is dormant, read keeping a dormant company compliant first.
Pay that meets the rules
The salary stated in the contract is examined against the permit category. For the new "Technical" category created by Act 13/2026 (in force by proclamation, section 61(3)), a monthly salary below MUR 50 000 can be accepted if it is not below the minimum fixed under the National Wage Consultative Council Act 2016. That category is aimed at contractual or technical staff under an approved government-to-government framework agreement, so it will not suit most private hires.
For other categories, the thresholds are set in the legislation and in current guidance. Do not rely on an old figure: the regime for residence permits was rewritten by the Finance Act 2025, and older guidelines still circulate online.
Housing and welfare
For the Technical category, the employer must prove adequate housing for the worker. Even outside that category, expect questions about where the employee will live and who covers maintenance and repatriation.
The 2025-26 Budget announced that the requirement for companies to lodge a deposit or provide a bank guarantee for the maintenance, support or repatriation of expatriate workers would be removed. It would be replaced by a non-refundable annual fee per expatriate worker. The amount was not fixed in the annex reviewed for this page, so check the rate that applies when you file.
How long a permit lasts
Validity depends on the category.
| Category | Maximum validity | Note |
|---|---|---|
| Professional (Occupation Permit) | Employment contract length or 10 years, whichever is shorter | Immigration Act 2022, section 12(8), as replaced by the Finance Act 2025 |
| Technical | 3 years initially, within the employment contract term | Renewable; created by Act 13/2026, in force by proclamation |
Two practical points follow. First, the contract term and the permit term should be aligned from the start; a contract that is longer than the permit creates a gap you will need to close. Second, a renewal is a new decision, not an automatic extension, so diarise it well ahead of expiry.
Timing: what to expect
The sources reviewed do not give a general processing time for ordinary work permits, so this page does not promise one. One narrow figure exists: the 2026-27 Budget provides for work permits of domestic employees accompanying a Golden Visa holder to be processed in 5 working days. That applies only to those domestic permits.
Plan the start date with margin. The worker should not begin work, even on a trial basis, before the permit is granted.

Duties while the permit is running
Getting the permit is the start. Most problems arise later, from small lapses.
Payroll and registration
Once the employee starts, they are on your payroll like anyone else. Register the company as an employer where it has not already done so, as explained in registering as an employer before hiring. Then apply the monthly deductions and returns: PAYE, CSG and NSF. The tax treatment of a non-citizen can differ from that of a local employee; see paying a foreign employee in Mauritius.
Pay slips and employment terms
Foreign employees have the same statutory protections as local staff. Issue compliant payslips (what a payslip must contain), respect leave entitlements and follow the rules in wages regulations and employer obligations. Any end of contract must respect the notice and severance rules in ending an employment contract.
Keeping the file current
Keep the permit, the contract, evidence of housing where it was required and any renewal correspondence in one place. Company records have their own retention rules; see company records: what to keep and for how long.
If the foreign hire is also appointed as a director or company secretary, notify the Registrar of the appointment within 28 days. Under section 142 of the Companies Act, a failure is an offence for each director and the secretary, with a fine of up to Rs 200 000. Residency rules for directors are separate; the resident director requirements explain them.
Employer checklist
- Company filings and registers are up to date
- The role is defined and the contract term is set
- The permit category has been matched to the role and pay
- Housing evidence is ready where the category requires it
- The current annual fee or other cost per expatriate has been confirmed
- The worker does not start before the permit is granted
- The employee is added to payroll, with PAYE, CSG and NSF set up
- A diary entry exists for renewal, well before expiry
- Any change in the job, pay or employer has been checked against the permit conditions
Common mistakes
- Starting early. Letting the person work while the application is pending exposes both sides to penalties.
- Using an old threshold. Guidance published before the Finance Act 2025 may describe superseded criteria.
- Mismatched dates. The contract ends after the permit, or the permit is renewed late.
- Ignoring changes. A new job title, a big change in pay or a change of employer can affect the permit's basis. Check before acting.
- Treating the permit as the whole job. Payroll, leave and records still apply from day one.
If your situation includes a group structure or a worker managing the company from abroad, the answer can change. A short analysis with a licensed adviser is worth more than guessing, and you can send a request through the site to be put in touch with an FSC-licensed corporate service provider (Management Licence).
FAQ
Do I need a work permit to hire a foreign employee in Mauritius?
Generally yes, unless the person already holds a status that allows them to work. The permit is tied to the job and the employer. Check the worker's existing status before assuming a new application is needed.
How long does a permit last?
For a professional Occupation Permit, validity is the length of the employment contract or 10 years, whichever is shorter. The new Technical category allows 3 years initially, renewable. Both depend on the legislation in force when you apply.
Can the employee start while the application is pending?
No. Do not let the person work before the permit is granted. The employer carries the risk of any breach.
Does a foreign employee pay PAYE and social contributions?
Pay is subject to the payroll rules for employees. The detail, including any difference for non-citizens, is explained in the linked pages on PAYE, CSG and NSF. Rates change, so use current official figures.
Is a deposit still required for expatriate workers?
The 2025-26 Budget announced the removal of the deposit or bank guarantee, replaced by a non-refundable annual fee per expatriate worker. The amount was not stated in the annex reviewed. Confirm the current position before filing.
What if the permit expires and we want to keep the employee?
Treat renewal as a fresh application and start early. Align the new contract term with the permit term.
